If you have been injured in a car accident in Ontario, regardless if you are at fault or not, you are entitled to claim benefits from your insurance company under the Ontario Statutory Accident Benefits Schedule.

Underage Driver Awarded Benefits Despite Driving Car Without Permission

Mr. P, an underage driver, was injured in a car accident after driving the car without the owner's permission. The Arbitrator was left to discern the state of mind of the driver, the insured, and the credibility of the parties involved.

Catastrophic Impairment - Onus on Insured to Prove Impairment

Nancy Stewart was injured severely in a motor vehicle accident in 2005. She brought a motion for a declaration of catastrophic impairment but failed to provide the expertise to support her claim. The Arbitrator denied her motion.

High Risk Activity Waivers are Valid When Properly Drafted

Waivers signed by people participating in high-risk recreational activities are valid where properly drafted. In the BC case two women sued a zip-line operator and lost, even where it was shown that operator negligence had caused them to collide.
